PROBLEMS OF ENFORCEMENT THE TOURISM BUSINESS AND GUIDE ACT B.E. 2551

Abstract

                The problem of the current Zero-Dollar Tour occurring was caused by foreigners entering to engage in tourism-related businesses, which consist of tour businesses, restaurants, accommodation or hotels, and shopping destinations in the tour program. It is the cause of a monopoly in the tourism activities and affected the use of domestic resources together with the income entering the country in which tourists spend. However, there is no additional income for domestic in management caused by tour business monopolies.  Although there is a law governing tourism businesses-Tourism Business and Guide Act B.E. 2551 (2008), in this regard, only tourism business founders must have Thai nationality. They could be a representative of foreigners in holding shares or operating such businesses e.g., tour businesses, restaurants, accommodation or hotels, and including various shopping destinations in the tour program. This Act is not fully efficient in tackling the legal problems of tourist business scope to prevent foreign monopoly resulting in the Zero-dollar Tour and causing the primary income of the country continuously.
