Lawyer Ethics in MahaSarakham Province Court

Abstract

การวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาระดับจริยธรรมของทนายความในศาล จังหวัดมหาสารคาม 2) ศึกษาปัญหาและข้อเสนอแนะ ในการปรับปรุงการปฏิบัติหน้าที่ ตามหลักจริยธรรมของทนายความในศาลจังหวัดมหาสารคามกลุ่มตัวอย่าง คือ ลูกความ ได้แก่ โจทย์ จำเลย หรือญาติ โดยใช้คดีที่เกิดขึ้นในระหว่างเดือนมกราคม–มิถุนายน ปี 2558 รวมทั้งสิ้น 385 คน เครื่องมือที่ใช้ในการเก็บรวมข้อมูลวิจัย คือ แบบสอบถาม มาตราส่วนประมาณค่า สถิติที่ใช้ในการวิเคราะห์ข้อมูล ได้แก่ ร้อยละ ค่าเฉลี่ย ส่วน เบี่ยงเบนมาตรฐาน ผลการศึกษาพบว่า ประชาชนมีความคิดเห็นความคิดเห็น เกี่ยวกับจริยธรรมต่อทนายความในศาลจังหวัดมหาสารคามโดยรวมอยู่ในระดับมาก ( = 3.68, S.D. = 1.09) เมื่อพิจารณาเป็นรายด้านพบว่า อยู่ในระดับมากทุกด้าน ส่วนปัญหา คือ 1) ทนายความไม่ตรงต่อเวลาในการไปว่าความทำให้ลูกความไม่อุ่นใจในการทำงาน ของทนายความ 2) เรื่องค่าจ้างทนายความหรือค่าตอบแทน 3) ทนายความโฆษณา อวดว่าตนเองเก่งกว่าทนายความคนอื่น และสามารถว่าความได้ทุกคดีแล้วสามารถ วิ่งเต้นคดี ว่ารู้จักอัยการ ผู้พิพากษา 4) ทนายไม่ค่อยมีเวลาให้ลูกความหรือทิ้งคดีความ ไม่ว่าความให้ต่อ และ 5) ทนายความที่เลือกรับคดีที่ตนเองถนัดทนายบางคนไม่เคยรู้ คดีพิพาทเลย ทั้งนี้จะเป็นแนวทางในการปฏิบัติงานต่อจริยธรรมของทนายความ เพื่อ จะนำไปพัฒนาหรือศึกษาเกี่ยวกับจริยธรรมทนายความในศาลเพื่อให้เกิดประสิทธิภาพ การทำงานของทนายความในศาลThe research aims to study 1) the ethic of lawyer in Maha Sarakham Province Court and 2) the problems and suggestions to improve the ethic duty of lawyer in Maha Sarakham Province Court. The sample used were prosecution or defense cases by relatives during the months from January to June 2015 is total of 385 people. The instrument used collecting data was a questionnaire. The statistics used in data analysis were percentage, mean, standard deviation. The study found that The public opinion about the ethic of lawyer in Maha Sarakham Province Court were at a high level ( = 3.68, S.D. = 1.09) when considering each side.
