Abstract

บทความนี้มีวัตถุประสงค์ศึกษาบทลงโทษของพระภิกษุที่ปาราชิกสิกขาบท 1 ใช้การวิจัยเชิงคุณภาพเพื่อทำความเข้าใจและแสวงหาบทลงโทษที่ควรจะเป็นต่อพระภิกษุที่อาบัติปาราชิกสิกขาบท 1 ซึ่งปาราชิกสิกขาบทนี้เป็นการกระทำ ที่มีความผิดขั้นสูงสุดที่พระพุทธเจ้าทรงบัญญัติห้ามมิให้พระภิกษุเสพเมถุนทรงปรับอาบัติปาราชิกแก่พระภิกษุผู้ล่วงละเมิดต้องขาดจากความเป็นพระ (อาบัติที่เป็นปาราชิกประกอบด้วย (1) การเสพเมถุนทั้งมนุษย์และสัตว์เดรัจฉาน (2) การลักทรัพย์ (3) การฆ่ามนุษย์และ (4) การอวดมนุสธรรม) โดยปาราชิกเปรียบดั่งโทษประหารของพระภิกษุ พระพุทธเจ้าทรงตรัสว่าพระภิกษุที่กระทำผิดในสี่เรื่องดังกล่าวเหมือนกับหินที่แตกแล้วไม่สามารถ ต่อได้อีก พระรูปใดทำผิดพระวินัยต้องลาสิกขาทันทีและไม่สามารถกลับมาบวชใหม่ได้พระภิกษุที่ต้องปาราชิกจึงเปลี่ยนสถานะจากผู้เผยแผ่ศาสนาเป็นฆราวาสหรือปุถุชนคนธรรมดาซึ่งบางรายที่กระทำผิดฐานเสพเมถุนได้รับบทลงโทษตามพระธรรมวินัยในพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 แต่ไม่ต้องรับโทษต่อกฎหมายบ้านเมืองหรือกฎหมายอาญา สามารถใช้ชีวิตเป็นปกติเสมือนไม่ได้ก่อความผิดใด จึงควรมี การแก้ไขกฎหมายอาญาและกฎมหาเถรสมาคมฉบับที่ 11 (พ.ศ. 2511) ว่าด้วยการลงนิคหกรรมเพื่อให้เกิดความชัดเจนและรัดกุมเพื่อเอาผิดกับพระภิกษุที่อาบัติปาราชิกสิกขาบท 1The objective of this article study legal punishment of monks to major offences training rule 1.
