LEGAL PROBLEMS ON THE ENFORCEMENTS OF HOTEL ACT, B.E. 2547

Abstract

                This research has the objectives to analyze legal problems on the enforcement of Hotel Act, B.E. 2547 for the benefits of hotel business operators and guests by applying archival research method to learn about the law of United States of America and Japan because they effectively apply the law to manage and systemized hotels which can solve and improve Thai laws according to international principles. The research indicated that there are various problems. The wastewater that was discharged by hotels did not treat through a standard sewage treatment because it was not required by law Hotel Act, B.E. 2547. The period of time to submit the copies of daily lodger registration card to the registrar office due to the location of the hotel-it might take longer than usual. The width of the entrance for incoming car toward  the hotel is not meet with the requirement by the law according to the Building Control Act (No. 5), B.E. 2558 and Bangkok Metropolitan Administration Regulation on Building Control, B.E. 2544. Each hotel did not set the same framework and hiring policy for qualifications of the hotel employees. According to the Hotel Act, B.E. 2547 did not establish the rule of law to do so, each hotel can hire whoever they see fit.

                The researcher suggested that the Hotel Act B.E. 2547 should be revise as followed: establishing specific guidelines for the construction of wastewater treatment systems in article 34/1 and time to submit the copies of daily lodger registration card the registrar according to article 35 and 36.
