SECURITY OF FUNDAMENTAL RIGHTS IN THE JUDICIARY

Abstract

                This academic article has the purpose of studying about the security of fundamental rights in the judiciary of the courts of law. It is the important essence of governmental principle in the democratic regime and state law principle - to have the security to be the duty of the state and the government in promulgating of the law to comply with the principle of security of right, both of international rules and to respect to human dignity to perform towards people in the status of being a material of the court judgment. It does not only mean  that people have the status as the right holders in judiciary process under Thai laws, not restricting whether it is judiciary of courts of justice, or judiciary of administrative courts. Therefore, the government shall do in every way to create the law system to comply with such principle, then the state will be considered as liberal democratic state having political and governmental system under state law principle.
