Abstract

                   A “smart contract” is one in which the terms and conditions of the contract are computerized and will be automatically be executed once those terms and conditions are met. The computerized code will then be stored using block chain technology, which is a decentralized network without third parties’ involvement. This will make it harder to amend or change the terms of the contract. The automated system of smart contract will automatically, correctly, credibly, and effectively facilitate the agreed parties in processing the transaction. Moreover, it helps reduce the number of steps, problems, or human errors that may occur when making the contract.  There is still the problem of whether or not the smart contract is under the control of the provisions that are enforced on normal electronic contracts, since there is no clear provision for the smart contract in the Electronic Transactions Act B.E.2544. Therefore, it is deemed appropriate to solve these problems by amending the Electronic Transactions Act in order to promote the creation of smart contracts in the private sector and improve the efficiency of smart contracts.
