บทบาทในฐานะพระอาจารย์ของ พระองค์เจ้ารพีพัฒนศักดิ์: ตอนงานสอนเรื่องกฎหมายลักษณะพยาน

Abstract

บทความนี้มีวัตถุประสงค์เพื่อแสดงให้เห็นถึงพระอัจฉริยภาพด้านกฎหมายของพระองค์เจ้า รพีพัฒนศักดิ์ ผู้ทรงเป็นพระบิดาแห่งกฎหมายไทย ผ่านบทบาทของพระองค์ท่านในฐานะอาจารย์ โดยมุ่งเน้นศึกษากฎหมายลักษณะพยานหลักฐานที่เป็นส่วนหนึ่งของกระบวนการพิจารณาของศาล ในการบรรยาย พระองค์ท่านได้อธิบายถึงวิธีพิจารณาคดีของศาลในขณะนั้นภายใต้บังคับของ กฎหมายตราสามดวง พร้อมทั้งเสนอแนะแนวทางการปรับปรุงแก้ไขให้เป็นสากล โดยสามารถแบ่ง ออกได้เป็น 4 ส่วนที่สำคัญ ได้แก่ ส่วนที่หนึ่งเรื่องการกำหนดประเด็นข้อพิพาท ส่วนที่สองเรื่องการ กำหนดภาระการพิสูจน์ ส่วนที่สามเรื่องการนำพยานหลักฐานเข้าสืบ ส่วนที่สี่เรื่องการชั่งน้ำหนัก พยานหลักฐานเพื่อตัดสินคดี ซึ่งความเห็นของพระองค์ท่านที่สอดแทรกในการบรรยายมีความ แตกต่างอย่างมากกับยุคกฎหมายตราสามดวง จึงส่งผลให้เกิดการริเริ่มพัฒนาวิธีพิจารณาคดีของ ศาลไทยให้เป็นธรรมยิ่งขึ้น อีกทั้งยังเป็นรากฐานในการบังคับใช้กฎหมายวิธีพิจารณาความของไทย ในปัจจุบัน จนทำให้ระบบกฎหมายไทยกลายเป็นที่ยอมรับของนานาอารยประเทศ

The Role as a Professor of Prince Rapeepattanasak: the Illustrated Lecture on Law of Evidence

The purpose of this article is to show a law genius of Prince Rapeephatthanasak, who is the father of Thai law, through his role as a professor, emphasising on his lecture about the law of evidence which is a part of court proceedings. In the lecture, he gave an explanation about the proceedings of court under the Three Seals Law and then offered valuable suggestions on how the law should be adjusted to become civilised. His advices could be divided into four main parts: the first part is the determination of the point in dispute; the second part is about the determination of the burden of proof; the third part is about adduce evidence; and the fourth part is about the preponderance of evidence for deciding cases. A study has shown that there are striking differences between his opinions interpolated in the lecture and the Three Seals Law enforcement; this, not only, leads to signs of legal improvement, but also builds a firm foundation for Thai legal process nowadays. As a result, the legal system of Thailand is, eventually, accepted by many civilised countries.
