The Criminal Procedure Code of Thailand vests an extensive discretion in issuing non-prosecution orders to public prosecutors. However, the Attorney General is exclusively authorized to have the discretion on non-prosecution orders by reasons of not for the public interest, which makes the deliberation whether it is for the public interest involving in multi stages and processes and resulting a delay. Furthermore, rules or regulations of the Office of the Attorney General are not clear in giving guidelines or criteria in making such order resulting in not achieving its goals and objects. The author is aware of this situation and presents legal opinions in resolving with respect to the problems for the ultimate purpose of criminal justice process improvement.
