กฎหมายผังเมืองกับการแก้ปัญหาน้ำท่วมภัยแล้งตามแนวทางของพระบาทสมเด็จพระจุลจอมเกล้าเจ้าอยู่หัว

Abstract

การจัดทำผังเมืองได้เริ่มมีมาตั้งแต่สมัยโบราณ การจัดทำผังเมืองในอดีตมีวัตถุประสงค์ เพื่อป้องกันข้าศึกศัตรู ต่อมาเมื่อเกิดการปฏิวัติอุสาหกรรมวัตถุประสงค์ของการจัดทำผังเมืองได้เปลี่ยนแปลงไป เป็นการควบคุมการใช้ที่ดิน สิ่งแวดล้อม ความปลอดภัย สวัสดิภาพของประชาชนและสาธารณูปโภค

ประเทศไทยสมัยโบราณสิ่งที่เป็นสาธารณูปโภคของไทยนอกจากทางเท้าทางเกวียนที่สำคัญ คือ แม่น้ำ ลำคู คลอง ซึ่งใช้เป็นทางสัญจร ในสมัยรัชกาลที่ 5 พระบาทสมเด็จพระจุลจอมเกล้าเจ้าอยู่หัว เป็นสมัยที่มีการสร้างสิ่งซึ่งเป็นสาธารณูปโภค ลำน้ำ คูคลองมากที่สุดสมัยหนึ่ง ทำให้การคมนาคม การบริหารจัดการน้ำสามารถประสบผลสำเร็จ การระบายนํ้ำช่วงที่เกิดอุทกภัย การกักเก็บน้ำไว้ใช้ยามหน้าแล้งได้ผลดี ทำให้เกิดพื้นที่เกษตรกรรม การติดต่อคมนาคมทางน้ำประสบผลดี

ประเทศไทยยังไม่มีกฎหมายและหน่วยงานที่ใช้ในการบริหารควบคุมน้ำโดยตรง แต่มีกฎหมายการผังเมืองที่ใช้ในการวางแผนการคมนาคมขนส่งและสาธารณูปโภคทั้งหมดรวมทั้งประเทศ คือ ผังประเทศ ผังภาค ผังเมือง รวมลงไปถึงผังเฉพาะกิจ แต่กลับไม่นำกฎหมายการผังเมืองมากำหนดวางผังแม่น้ำ ลำคู คลอง แหล่งกักเก็บน้ำ เพื่อการบริหารจัดการน้ำให้เป็นระบบทั้งประเทศเพื่อป้องกันอุทกภัย และภัยแล้งที่เกิดขึ้นประจำทุกปี ก่อให้เกิดการเสียหายทุกภาคส่วนทั้งชีวิตของประชาชน และต่อเศรษฐกิจของประเทศ

ดังนั้น ถึงเวลาที่ต้องนำนโยบายของพระบาทสมเด็จพระจุลจอมเกล้าเจ้าอยู่หัวและกฎหมาย ผังเมืองที่มีอยู่ในขณะนี้มาใช้ในการวางแผนการควบคุมบริการจัดการน้ำ ในขณะที่ยังไม่สามารถออกกฎหมายขึ้นมาใช้ได้เฉพาะเพื่อไม่ให้เกิดปัญหาอุทกภัยหรือภัยแล้งซ้ำซาก

Town planning has long been existed in Thailand since ancient times. The objective of town planning in the past is to protect the country from the enemy. Later, after the industrial revolution, the objective of town planning has been changed from the protection of the country to the control of land using, environment, public safety, public welfare and public service.

In the past, pavements, pathways and wagons, including rivers and canals, are among the public services in Thailand which have been used as public transportation. The building of rivers, ditches and canals, achieving in transportation and water administration, are most found in the reign of King Rama V. At that time, the drainage in the event of flooding and the retention of water in the event of drought, bring to the achievement of agricultural areas and water transportation.

Thailand does not have specific law and public organization to control water system directly but only has the Town Planning Act that supports the traffic transportation and public service planning for the country as a whole which includes the country plan, region plan, general plan and specific plan. However, the Town Planning Act is not the law for the planning of rivers, ditches, canals or water reservoirs and has not been used for managing the water system and protecting the flood and the drought which are the problems that bring the damage to all sectors in the country including the damaging of lives and economy every year.

Therefore, while there is no specific law to resolve the problem, it is a high time to bring the King Rama V policy and the Town Planning Act together to make a plan for controlling and managing water and to prevent the redundant of flooding and drought.
