มาตรการทางกฎหมายเกี่ยวกับการจัดการฟุตบอลอาชีพ: ศึกษาเปรียบเทียบกฎหมายไทยและต่างประเทศ

บทคัดย่อ
กีฬาฟุตบอลเป็นกีฬาที่ได้รับความนิยมมากในประเทศไทยและสามารถพัฒนาจนกลายเป็นกีฬาอาชีพที่สร้างรายได้และผลตอบแทนทางธุรกิจได้อย่างน่าสนใจ ซึ่งส่วนหนึ่งของการจัดการฟุตบอลอาชีพให้เป็นไปด้วยความเรียบร้อยก็คือการนำมาตรการทางกฎหมายมาช่วยในการจัดการ ทั้งนี้เนื่องจากในการจัดการฟุตบอลอาชีพนั้นต้องมีการปฏิสัมพันธ์ของบุคคลหรือหน่วยงานต่างๆ ในหลายส่วน ซึ่งหลายประเทศที่มีพัฒนาการด้านการจัดการฟุตบอลอาชีพที่อยู่ในระดับสูงในปัจจุบันก็ล้วนแต่มีการนำมาตรการทางกฎหมายมาใช้เป็นส่วนหนึ่งของการจัดการทั้งสิ้น เพียงแต่ในแต่ละประเทศอาจจะมีโครงสร้างที่แตกต่างกันไปตามแต่บริบทของสังคม ระบบกฎหมาย และวัฒนธรรมฟุตบอลท้องถิ่น
โดยในปัจจุบันประเทศไทยได้มีการบัญญัติกฎหมายเกี่ยวกับการจัดการกีฬาอาชีพขึ้นมาบังคับใช้เป็นการเฉพาะ คือ "พระราชบัญญัติส่งเสริมกีฬาอาชีพ พ.ศ.2556" ซึ่งสามารถนำมาใช้กับการจัดการฟุตบอลอาชีพได้ในหลายส่วน แต่เนื่องจากการบัญญัติกฎหมายสำหรับการจัดการกีฬาอาชีพโดยเฉพาะถือเป็นเรื่องใหม่สำหรับประเทศไทย ดังนั้นการศึกษาโครงสร้างมาตรการทางกฎหมายที่เกี่ยวกับการจัดการฟุตบอลอาชีพของประเทศที่มีศักยภาพในการจัดการฟุตบอลอาชีพระดับสูงบางประเทศเปรียบเทียบกับของประเทศไทยจึงถือว่าเป็นประโยชน์สำหรับการกำหนดแนวทางในการบังคับใช้มาตรการทางกฎหมายสำหรับการจัดการฟุตบอลอาชีพของประเทศไทยได้อย่างมีประสิทธิภาพต่อไป
