บทคัดย่อ
สมาคมแห่งประชาชาติเอเชียตะวันออกเฉียงใต้ หรืออาเซียน กำหนดหลักการไม่แทรกแซงกิจการภายในรัฐสมาชิกอาเซียนอื่นไว้ในกฎบัตรอาเซียน ข้อ 2 (2) อี หลักการนี้กำหนดว่ารัฐสมาชิกอาเซียนจะต้องไม่แทรกแซงกิจการภายในของรัฐสมาชิกอาเซียนอื่น เช่น การไม่ใช้กำลังโดยตรงต่อรัฐสมาชิกอาเซียนอื่น ไม่วิพากษ์สถานการณ์ภายในของรัฐสมาชิกอาเซียนอื่น รวมทั้งไม่กระทำการใดๆ ที่เป็นการก้าวก่ายเขตอำนาจภายในของรัฐสมาชิกอาเซียนอื่น
บทความนี้มุ่งศึกษาประเด็นหลักการไม่แทรกแซงกิจการภายในตามกฎบัตรอาเซียนเป็นสำคัญ โดยศึกษาเปรียบเทียบกับหลักการไม่แทรกแซงกิจการภายในตามกฎบัตรสหประชาชาติ ทำให้เห็นได้ว่ารัฐสมาชิกอาเซียนมีแนวปฏิบัติต่อหลักการไม่แทรกแซงกิจการภายในรัฐสมาชิกอื่นตามกฎบัตรอาเซียนอย่างเคร่งครัดกว่า
ทั้งนี้ ผู้เขียนเห็นว่าการที่รัฐสมาชิกอาเซียนมีแนวปฏิบัติที่เคร่งครัดต่อหลักการไม่แทรกแซงกิจการภายในรัฐสมาชิกอื่น อาจเป็นอุปสรรคในการให้ความร่วมมือ การจัดการ รวมทั้งการแก้ไขปัญหาที่เกิดขึ้นภายในภูมิภาค
