Fiscal Decentralization to Local Government : Thai Constitution 2560

Abstract

In this documentary and descriptive research investigation, the researchers analyze  the laws related to the fiscal decentralization to local government in accordance with the Constitution of the Kingdom of Thailand B.E. 2560 (2017); compare the people’s participation in various relevant laws; analyze the weaknesses and strengths in the implementation of the decentralization to local government in accordance with the constitution of the Kingdom of Thailand B.E. 2560 (2017); and propose practical guidelines to encourage the people’s participation in the decentralization to local government process in accordance with the Constitution of the Kingdom of Thailand, B.E. 2560 (2017). Findings show that there are eight laws and regulations at a national and local level related to fiscal decentralization to local government. However, no laws or regulations specify a direct participatory budgeting process. Guidelines and practices concerning fiscal participation therefore are unclear. At times there are conflicts and resolutions cannot be reached. An amendment of the laws has sought to define more clearly the guidelines and practices concerning the people’s participation to provide more clarity to the fiscal decentralization procedures. A draft Act on the People’s Participation in the Public Policy Process is being considered by the National Legislative Assembly.
