บทคัดย่อ
ระบบกฎหมายกำกับกีฬานำการระงับข้อพิพาททางเลือกในบางรูปแบบมาใช้ระงับข้อพิพาทระหว่างกันผู้มีส่วนได้ส่วนเสียในวงการกีฬาโดยไม่ต้องนำคดีขึ้นสู่ศาล โดยการระงับข้อพิพาทในทำนองนี้ ถือเป็นกระบวนการระงับข้อพิพาทนอกศาลอันเป็นที่ยอมรับนับถือวงการกีฬาสากลเพื่อใช้เป็นวิธีระงับข้อพิพาททางการกีฬา ด้วยความเป็นอิสระในการกำกับกีฬาในแต่ละชนิดกีฬาได้ก่อร่างสร้างขั้นตอนและวิธีการในกระบวนการพิจารณาคดีทางการกีฬาเพื่อตีความและบังคับใช้กฎหมายกีฬาสากล อีกทั้ง การกำกับตนเองในแต่ละชนิดกีฬาสากลนั้นยังให้อำนาจสหพันธ์กีฬานานาชาติหรือองค์กรกำกับกีฬาสากลให้ใช้อำนาจปกครองสมาชิก ผ่านการกำหนดให้สมาชิกหรือผู้มีส่วนได้ส่วนเสียที่เป็นคู่ความหรือคู่พิพาท ใช้กระบวนการยุติธรรมทางเลือกมาเป็นกระบวนการในการระงับข้อพิพาททางกีฬาระหว่างกัน บทความฉบับนี้ประสงค์ที่จะอภิปรายความสำคัญของการระงับข้อพิพาทนอกศาลที่ถูกนำมาใช้ระงับข้อพิพาทในกีฬาสากล รวมทั้งอธิบายบทบาทของการไกล่เกลี่ยข้อพิพาทในฐานะที่เป็นรูปแบบของการระงับข้อพิพาททางเลือกในรูปแบบหนึ่งที่ถูกนำมาใช้ในวงการกีฬาอย่างแพร่หลาย อีกทั้งนโยบายกีฬาสากลต่างก็ขานรับการใช้รูปแบบการระงับข้อพิพาททางเลือกด้วยการไกล่เกลี่ยข้อพิพาท โดยเห็นพ้องต้องกันว่า การไกล่เกลี่ยข้อพิพาทนอกศาลมีประสิทธิภาพในการระงับข้อพิพาททางการกีฬาเป็นอย่างมาก บทความฉบับนี้ได้หยิบยกความเชื่อมโยงระหว่างหลักการไกล่เกลี่ยข้อพิพาททั่วไปกับประสบการณ์การนำเอาการไกล่เกลี่ยข้อพิพาทมาใช้ในกีฬา อีกทั้งยังได้หยิบยกกระบวนการไกล่เกลี่ยข้อพิพาทภายใต้กฎเกณฑ์ของสหพันธ์ฟุตบอลนานาชาติมาอภิปราย โดยเฉพาะอย่างยิ่งมาตรการสนับสนุนให้มีการใช้การไกล่เกลี่ยข้อพิพาทในกีฬาฟุตบอลสากลภายใต้ มาตรา 20 แห่งกฎวิธีสบัญญัติของสถาบันตุลาการแห่งสหพันธ์ฟุตบอลนานาชาติ
