การคุ้มครองสิทธิคนพิการในสาธารณะรัฐประชาธิปไตยประชาชนลาว: ศึกษาเปรียบเทียบกับประเทศไทย และประเทศอื่นๆ

Abstract

The purpose of this research is to conduct a comparative study on legal problems and measures for the protection of disabled people rights in Lao People’s Democratic Republic (Lao P.D.R.) with Thailand and other countries.This is to ensure that it complies with the standard rules on the International Convention on the rights of persons with disbilities 2006. The disable people should have equality and equal protections like other normal people. They might become one of the important group of people to develop country if they are appropriately protected and offered preferential policy from government that conform with the International Convention of the Rights Persons with Disabilities. It is can be seen that there is currently no specific law for disabled people in Lao P.D.R.There are some general regulations in each law for utilizing into practice, thus it is absolutely uncomprehensive to the protection of disabled people rights, concerning legal problems on these issues in Lao P.D.R. This research is to find suitable measures to solve problems by conducting a comparative study in Thailand because Thailand is a member of the International Convention on the Rights of Persons with Disabilities like LaoP.D.R. 

The results reveal that Lao P.D.R. has entered the member of the International Convention on the Rights of Persons with Disabilities 2006. According to its obligation Lao P.D.R. has to implement and amend its legal system in order to get along with each others. Although Lao P.D.R. has established the National Committee for Disabled People by Prime Minister Degree No. 061/PM adopted date 6March 2009 to be as the main regulation guideline of government and the Prime Minister to implement, coordinating with concerning government organizations for protection, administration, supportive, rehabiltation to disabled people throughout the country.However all regulations adopted by government not able to conform with the Convention on the Rights of Persons with Disabilities as a result of reflection to inaccessability of disabled people. It is also not garantee the equalities occurred with them such as the right to access justic system specificly on interpretor for disabled people under the law of criminal procedure, the right to access education under the law of education specificly on the criteria of teacher and educational materials for disabled people students, the right to access public services specificly on public toilet, public bulding and sidewalks for disabled people, the right to access the mass media and information under the Law of Media, the right to access the opportunities of working under the Labour Law, the right to have rehabilitation and public health care activities such as the sports.Those rights above are absolutely adopted in the Convention on the Rights of Persons with Disabilities 2006.
