บทคัดย่อ
บทความวิจัยนี้มุ่งศึกษาผลกระทบและเสนอมาตรการที่เหมาะสมต่อประกาศกรมการขนส่งทางบก เรื่อง กำหนดหลักเกณฑ์ วิธีการและเงื่อนไขในการขออนุญาต การอนุญาต ระยะเวลาในการใช้รถ และเครื่องหมายแสดงการใช้รถที่นำเข้ามาในราชอาณาจักรเป็นการชั่วคราว เพื่อใช้ในการท่องเที่ยวหรือการอื่นใดที่มีความจำเป็นเฉพาะกรณี พ.ศ. 2559 ซึ่งเป็นวิจัยเชิงคุณภาพ ได้แก่ การวิจัยเอกสาร การสัมภาษณ์เชิงลึก การประชุมกลุ่ม (Focus Group) และการลงพื้นที่เก็บข้อมูลบนเส้นทาง R3A
จากการศึกษาพบว่า ภายหลังจากประกาศกรมการขนส่งทางบกฯ ใช้บังคับ ทำให้นักท่องเที่ยวจีนที่ขับรถยนต์ส่วนบุคคลเข้ามาประเทศไทยทางด่านตรวจคนเข้าเมืองเชียงของ จังหวัดเชียงราย มีจำนวนน้อยลงอย่างมาก ส่งผลต่อธุรกิจในภาคอุตสาหกรรมท่องเที่ยวของจังหวัดเชียงรายและเชียงใหม่ โดยเฉพาะพื้นที่อำเภอเชียงของ จังหวัดเชียงราย แต่เมื่อวิเคราะห์ความเหมาะสมของมาตรการทางกฎหมายดังกล่าว เห็นว่า ควรให้คงประกาศกรมการขนส่งทางบกฯ ฉบับนี้ไว้เพื่อเป็นเครื่องมือทางกฎหมายในการควบคุมการนำรถยนต์จากต่างประเทศเข้ามาใช้ในประเทศไทยเช่นเดิม แต่ควรปรับปรุงเนื้อหาของประกาศฉบับดังกล่าว ใน 3 ระยะ ได้แก่ ระยะสั้น ลดขั้นตอนและระยะเวลาขออนุญาตนำรถยนต์มาใช้ลง โดยจัดตั้งศูนย์บริการจุดเดียวเบ็ดเสร็จที่ด่านพรมแดนเชียงของ และประกาศให้อำเภอเชียงของเป็นเขตอนุญาตให้รถยนต์จากต่างประเทศเข้ามาใช้ได้ (Free Zone) แต่ต้องผ่านการทำประชาพิจารณ์จากคนในพื้นที่เสียก่อน ระยะกลาง รัฐบาลไทยควรทำความตกลงกับรัฐบาลจีนเพื่อยอมรับการขับรถยนต์ร่วมกัน และระยะยาว ประเทศบนเส้นทาง R3A ควรทำให้กฎหมายการขับรถยนต์ข้ามแดนสอดคล้องกัน (Harmonization of Law)
