บทคัดย่อ
บทบัญญัติเกี่ยวกับการปราบปรามการรับทรัพย์สินหรือประโยชน์อื่นใดตามพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริต พ.ศ. 2542 มาตรา 103 และมาตรา 123/2 ไม่สามารถปรับเพื่อลงโทษผู้กระทำความผิดตามข้อเท็จจริงที่ปรากฏได้ ประกอบกับโทษที่กำหนดตามบทบัญญัติของกฎหมายทั้งสองฉบับไม่สอดคล้องต้องกัน และล้าสมัย กล่าวคือไม่ปรากฏบทบัญญัติในลักษณะที่เป็นความหลากหลายของการลงโทษ ซึ่งไม่ตอบสนองต่อการกระทำที่เป็นความผิดในลักษณะที่เรียกว่าอาชญากรรมทางเศรษฐกิจ เป็นเหตุให้การบังคับใช้กฎหมายเกิดความไม่เด็ดขาด ประกอบกับจากการศึกษาเนื้อหากฎหมายในประเทศที่ประสบความสำเร็จในการป้องกันและปราบปรามการทุจริตคือประเทศสิงคโปร์ พบว่าการบัญญัติกฎหมายของประเทศเหล่านี้มีลักษณะเป็นการทำให้บทบัญญัติเป็นอันหนึ่งอันเดียวกัน การกระทำที่เป็นความผิดจะมีลักษณะในทางเดียวกัน หรือเหมือนกันแทบทั้งหมด ทำให้การบังคับใช้นั้นครอบคลุม เด็ดขาด และสมประสงค์เจตนารมณ์แห่งกฎหมาย ดังนั้นแล้วสมควรที่จะนำมาใช้สำหรับอ้างอิงเพื่อเป็นประโยชน์ในการแก้ไขกฎหมายเกี่ยวกับการป้องกันและปราบปรามการรับทรัพย์สินหรือประโยชน์อื่นใดต่อไป
