Abstract
This study on the legal measures on issuing and renewing the permission of sand suction in Mekong River with the purpose to investigate the problems of the legal measures on issuing the permission of sand suction in Mekong River and the problems of the legal measures on renewing the permission of sand suction in Mekong River, this study aims to compare the permission issue from relevant agencies both from Thailand and foreign countries and find out the solutions to issuing and renewing the permission of sand suction in Thailand with a higher degree of clarity , fastness, and efficiency. This study is a document study by searching for information from various documents both from Thailand and foreign countries.
The findings revealed that there are three problems issues. Firstly, regarding the international laws related to sand suction in Mekong River, there are no strictly compulsory measures and they are inconsistent with the current situations. Secondly, regarding the incomprehensiveness of the subordinate legislation, the overlap of laws brings about the difficulty of issuing and renewing the permission. And lastly, renewing the permission of sand suction takes a long time. Moreover, each permission contains different duration of time and specifies the different period of time to ask for renewal permission causing the excessive burden to entrepreneurs and resulting in the problems of nonrenewal permission. The refore suggest determining the issue of only main permission of sand suction, determining other related notifications or registrations, moving the sand suction business into the biz portal and providing the sub-committees to consider the permission of sand suction in Mekong River, as well as proposing the conduct of the Environmental Impact Assessment report.
