PROBLEMS OF SENATORS ACQUISITION INCONSISTENT WITH DEMOCRATIC REGIME

Abstract
The objective of this study was to examine problems of senator acquisition inconsistent with democratic regime by considering the Constitution of the Kingdom of Thailand in following aspects: 1) the senator acquisition elected by the people, 2) the senator acquisition by direct election and nomination, 3) the senators acquisition who were not elected by the people. This study was qualitative research by analyzing legal documents, concepts and theories.
The study results indicated that senators elected by the people appeared in the Constitution of the Kingdom of Thailand, B.E. 2489, eighty senators were indirectly elected. The constitution of the Kingdom of Thailand, B.E. 2540, two hundreds senators were elected by the people which congruent with democratic regime. 2) The senators by direct election and recruiting appeared in the Constitution of the Kingdom of Thailand, B.E.2550, one hundred and fifty senators were elected for one person per province, and from the nomination of the Nomination Committee. Which was inconsistent with the democratic regime. And 3) the senators who were not elected by the people appeared in the Constitution of the Kingdom of Thailand (Provisional) B.E. 2490, 2492, 2511, 2517, 2518, 2521, 2534, and 2560, the acquisition of senators, were appointed from qualified persons in various fields by the King or the one who was a recipient of the royal command. Therefore, it proposed that senators should be directly elected by the people, the same as the constitution of the Kingdom of Thailand, B.E. 2540.
