Abstract

The purpose of this research is to study the development of the interpretation of the words “ Sexual assault ” , “ Indecent act ” , “ Sexual Assault by Penetration ” according to Thai law and to study the measures of foreign laws related to the interpretation of the word “ Sexual assault ” , “ Indecent act ” , “ Sexual Assault by Penetration ” by fighting in England and Germany Studies have shown that Thailand has developed the terms sexual assault and Indecent act. The study began when the criminal law R.S.127 was adopted. The perpetrator was changed from "which man" to using the word "whom" instead, which can be interpreted to mean that the perpetrator can be both a woman and a man and Indecent act to this law is an inappropriate sexual act. You also have to look at the intentions of the perpetrators. Therefore, the doer and the victim can be both women and men. Sexual Assault by Penetration has not yet been provided for in this edition.


            Thailand uses the criminal law R.S. 127 until 1956 a new law has been drafted. It is called the Criminal Code that was introduced in 1957 and is still in use today. The offense of sexual assault is defined in the Criminal Code, Section 277. The perpetrator can be both a woman and a man. This is because the use of the word “whoever” is used and the offense is accomplished only when the penis has penetrated into the female genitalia. and the offense of indecency stipulated under Section 278, the offense of indecent exposure to a person over 15 years of age, and under Section 279, the offense of indecent exposure to a child under 13 years of age. Criminal Code Section 278 and Section 279 The perpetrators under this section do not limit the gender of the perpetrator and the victim and the act that is considered obscene must not be sexual assault. But it is an inappropriate sexual act. Whether it is direct contact with the victim's body or through clothing and the part about indecent intrusion has not yet been provided for in this amendment of the law.


์            No.19 Amendment to the Criminal Code contains amendments to the sexual assault section. which has an expanded meaning beyond natural sexual intercourse Covers the use of anything else inserted into the anus. or genitals as well the part of the obscene act has not been amended in any way.


            No.27 Amendment to the Criminal Code amended the sexual act section by anything else or an organ other than the penis inserted into sexual organ or the anus of the victim which was moved to be a serious matter of indecency It is an offense of sexual assault by penetration and the offense of indecency must be an act with the aim of suppressing one's own or others' sexual desires and must be committed against the person's body.


            When compared with foreign standards, it was found that the offense of sexual assault in England and Germany Offenders can be both men and women. and there will be penetration into the genitals, mouth, or anus of the victim. In the case where organs or other things are used In England it is also classified as an offense of sexual assault.


            Indecent act in English and German Laws That is an inappropriate sexual act with the outside body towards another person. and actions that will cause shame to the victim and there must be no penetration, but there will be a difference in the age of consent only.
