Abstract

At present, defective medicinal products cause injuries to consumers in Thailand. Meanwhile, most of the existing legislation in Thailand, with respect to medicinal products, centres on product liability law and seeks to put in place remedial measures by providing compensation for harm caused to consumers by unsafe products. However, there are limitations of safety measures in Thailand, especially in terms of medicinal products, which will lead to the continuously raising of defective products in the market.

Therefore, it is essential to set forth safety measures for medicinal products as a preventive measure to protect consumers before defective products cause injuries. This article presents the legal problems of the current safety measures for medicinal products in Thailand and suggests effective solutions for enacting concrete safety measures for medicinal products.
