Abstract

ประเทศไทยมีพันธกรณีในการเปิดเสรีการค้าบริการ และได้ทำความตกลง ยอมรับร่วมกันในคุณสมบัติ ภายใต้แผนงานการจัดตั้งประชาคมเศรษฐกิจอาเซียน เพื่อการอำนวยความสะดวกให้เกิดการเคลื่อนย้ายบุคลากร ในสาขาการท่องเที่ยว ในภูมิภาคอาเซียน เพื่อให้มีการควบคุมดูแลด้วยมาตรฐานที่ดีร่วมกันในอาเซียน มากกว่าที่จะสร้างเงื่อนไขการขอรับใบอนุญาตให้คนต่างชาติเข้ามาประกอบอาชีพ แต่เนื่องจากกฎหมายของไทยที่เกี่ยวข้องกับการบริการธุรกิจนำเที่ยว และ มัคคุเทศก์ถือเป็นอุปสรรคในการเปิดเสรีการค้าบริการ คือ พระราชบัญญัติธุรกิจ นำเที่ยวและมัคคุเทศก์ พ.ศ. 2551 และ พระราชบัญญัติประกอบธุรกิจของคน ต่างด้าว พ.ศ. 2542 ซึ่งเมื่อมีการเปิดเสรีการค้าบริการในสาขาดังกล่าว จะต้อง มีการปรับเปลี่ยนกฎหมายที่เกี่ยวข้อง เพื่อเป็นการลดอุปสรรคในการเข้าสู่ตลาด และให้บรรลุเป้าหมายของการเปิดเสรีการค้าบริการภายใต้วัตถุประสงค์ของ ประชาคมเศรษฐกิจอาเซียนและผลประโยชน์ของประเทศไทยควบคู่ไปด้วย

Under the ASEAN Economic Community Blueprint, Thailand has an obligation to liberalize trade in services and Mutual Recognition Arrangement: MRA to facilitate the movement of personnel in the tourism field in the region (Foreign Tourism Professional) to provide regulation and supervision with a common good standard in ASEAN more than to create the conditions due to work permit procedure for foreigners to perform such profession in Thailand. a person giving touris and tour business professional services Who is Thai is subject to the law on Business Tour and Guide , Business foreigner, which still contains some restrictions that are obstacles to the consideration of permission to work in the Kingdom of Thailand. Any unconformity or inconsistency will certainly cause difficulties in the process of permission to work freedom in ASEAN. Therefore to concretely achieve the goal of liberalizing 82 of relevant Thai laws are required.
