Public Opinion on The Enforcement Decree of Emergency on Public Administration inEmergency Situation, B.E. 2548 in TheSouthern Border Provinces of Thailand

Abstract

จังหวัดชายแดนภาคใต้มีการบังคับใช้พระราชกำหนดการบริหารราชการ ในสถานการณ์ฉุกเฉิน พ.ศ. 2548 ตั้งแต่ พ.ศ. 2548 ถึงปัจจุบัน พ.ร.ก. ฉบับนี้ เป็นกฎหมายลักษณะพิเศษ จึงมีความจำเป็นที่ต้องศึกษาความคิดเห็นของ ประชาชนที่มีต่อการบังคับใช้ในพื้นที่จังหวัดชายแดนภาคใต้ การวิจัยนี้ดำเนินการ เก็บรวบรวมข้อมูลเชิงปริมาณจากประชาชนในสามจังหวัดชายแดนภาคใต้ ได้แก่ ปัตตานี ยะลา และนราธิวาส รวม 619 คน ด้วยวิธีการสุ่มแบบหลายขั้นตอน วิเคราะห์ข้อมูลด้วยสถิติพรรณาและอนุมาน ประกอบกับการเก็บข้อมูล เชิงคุณภาพจากกรณีศึกษาจากเจ้าหน้าที่ภาคประชาสังคมและเจ้าหน้าที่ของรัฐ ด้วยการวิเคราะห์เนื้อหา รวม 30 คน เพื่อให้ทราบถึงปรากฏการณ์ที่ลุ่มลึกและ ขยายความเข้าใจต่อข้อมูลเชิงปริมาณ ผลการวิจัย พบว่า พ.ร.ก. ฉบับนี้มี เจตนารมณ์เพื่อจัดการสถานการณ์ความไม่สงบในพื้นที่จังหวัดชายแดนภาคใต้ ซึ่งประชาชนไม่เห็นด้วยกับการบังคับใช้ พ.ร.ก. ในพื้นที่และไม่แน่ใจต่อ สถานการณ์ความรุนแรงในพื้นที่ หากมีการประกาศยกเลิกการบังคับใช้ ข้อเสนอ แนะเชิงนโยบายจากผลการวิจัย มี 2 กรณี คือ การประกาศ “ขยายระยะเวลา ประกาศสถานการณ์ฉุกเฉินที่มีความร้ายแรงในท้องที่” และประกาศการบังคับใช้ พ.ร.ก.ฉุกเฉิน พ.ศ. 2548 ในพื้นที่จังหวัดชายแดนภาคใต้ หรือ การประกาศ “ยกเลิกสถานการณ์ฉุกเฉินที่มีความร้ายแรงในท้องที่” ในจังหวัดชายแดนภาคใต้

Public Opinion on The Enforcement Decree of Emergency on Public Administration in Emergency Situation, B.E. 2548 in The Southern Border Provinces of Thailand

Decree of Emergency on public administration in emergency situation B.E. 2548 has been enforced since 2548 in the Southern border provinces of Thailand. This decree is the special law. The public opinion on this enforcement is necessary most. This research approach used quantitative data from 619 samples from Pattani, Yala and Naratiwas. The 619 samples were selected by multi-stage random sampling technique. Data from those samples were analyzed by inferential and descriptive statistics. Beside, the qualitative data from the civil societies and government officers had used for comprehension the quantitative data. The research results point that this decree has used for public administration but the people disagree with the enforcement. Moreover the people feel hesitatingly if the decree is unenforced. The research proposition suggests that there are two policy recommendations; the expansion of enforcement period and the declaration of termination of enforcing this decree in the Southern border provinces of Thailand.
