Abstract

This academic article aims to analyze the legal problems impeding the development to transform the Provincial Waterworks Authority to become public limited company by studying the State Enterprise Capital Act B.E. 2542 (1999), Provincial Waterworks Authority Act, B.E. 2522 (1979), privatization concept, public service provision theory, and common interests protection principles for analysis.


The analysis results showed that the problems that impede the development of the Provincial Waterworks Authority to be a public limited company under the State Enterprise Capital Act B.E. 2542 are the transfer of assets which are public assets for the common use by the citizen, when transfer under Section 24, shall no longer be public assets resulting in the Provincial Waterworks Authority has to pay the rent which will finally affect the water unit rate designation. The issue of the public power in expropriation of land, pipeline laying and equipment installation over or across the land of the private sectors.
