Legal Measures for Determining the Liability of Social Network Service Providers Violating Individual Privacy

Abstract

This research article aims to study (1) the problem of protecting the privacy rights of individuals in social network (2) civil and criminal liability issues of online social network providers violating the individuals’ rights (3) the burden of proof of liability of service providers under the civil and criminal procedural laws, and (4) to propose a draft legal measure to determine the civil and criminal liability of social network service providers who infringe individual’s privacy rights. The researcher used a qualitative research model and collecting data through documentary research and in-depth interviews and analyzed the data by using content analysis techniques and comparison interpretation.


The results showed that Thailand still lacked of comprehensive specific law to protect personal data. Civil and criminal and various related laws in Thailand did not have the provisions to protect the privacy rights of an individual, whether in the form of comprehensive or sectoral laws. Therefore, it was suggested that there should be a comprehensive specific law to protect the privacy rights of individuals. Moreover, a code of conduct and self-regulatory measures should be issued to protect personal data stored in electronic form for the protection of the privacy rights of individuals when using online social networks in the future.
