Agricultural Disaster Compensation in the Land Leasing for Agriculture According to The Land Lease for Agriculture Act B.E. 2524

Abstract

This academic paper aims to analyze agricultural disaster compensation in the land leasing for agriculture according to The Land Lease for Agriculture Act B.E. 2524. In this study, Good practice guidelines for agricultural leasing arrangements, history of Thai agricultural land lease laws, Land Lease for Agriculture Act B.E. 2524, measures to protect land tenants affected by natural disasters and the agricultural disaster compensation system in Japan as a framework for analysis. In this study, the good precipice guideline for agricultural leasing arrangements, Measures to protect land tenants who have suffered natural disasters and agricultural disaster compensation of Japan are applied as an analytical framework.


The results of the analysis showed that compensation for damages by the state there is a multi-stage inspection system that causes delays and damages are not immediately compensated, Therefore, legal measures are needed to protect land tenants against damage caused by natural disasters by applying insurance principles. Damage to agricultural crops is a statutory measure compulsory in additional land lease clauses. And the power of the agricultural land lease committee has the power to reduce or exempt the rent of land to land tenants. In the case of damage caused by natural disasters to compensate for the damage incurred quickly without the need for farmers to wait for help from the state.
