The Implementation of Conspiracy in the Organic Act on Anti-Corruption B.E. 2561

Abstract
This academic article aims to analyze the application of conspiracy in the Organic Act on Anti-Corruption B.E. 2561 by applying the concepts and theories about conspiracy. It includes the meaning, concepts of conspiracy principles in the common law system and the civil law system and the conspiracy principles under relevant Thai law. Including the Organic Act on Anti-Corruption B.E. 2561 as a framework for analysis.
Findings are as follows: The Organic Act on Anti-Corruption B.E. 2561 does not apply conspiracy in the same way as the Criminal Court for Corruption and Misconduct Act B.E. 2559, Section 3 (5). Organic Act on Anti-Corruption B.E. 2561 by requiring the NACC under Section 28 (1) (2) and (4) to include action against other persons who are "conspirators" also, regardless of whether there are charges or other related offenses included or not.
