The Development of Legal Measures Related to Security Business

Abstract
This research article aims to study (1) legal problems related to security business in Thailand; (2) concepts and theories related to the security business; (3) analyze and compare legal measures related to security business between Thai and foreign laws; and (4) develop and improve the law on legal measures related to security business in Thailand to be appropriate by using a qualitative research method and collecting data through documentary research, in-depth interviews and focus group discussion and analyzed the data by using content analysis techniques and comparison interpretation.
Findings are as follows: (1) The nationality of security guards: The Security Act, B.E. 2558, Section 34 designates that applicants for security guard licenses must have Thai nationality only. This affects business operators. There is a lack of labor for security guards. It also deters the development of policy and regulations regarding the employment of migrant workers. (2) The protection of the rights regarding the employment of migrant workers as security guards: There is no provision regarding employment contracts as well as training quality and standards. The determination of regular working hours and compensation for overtime is not appropriate and fair. (3) The supervision of security business organizations: There is a lack of personnel with knowledge, ability, and expertise. The determination of authority and duties in the development of security business is not clear. This results in the lack of support and standards in regard to the ethics of companies and security guards.
