ผลกระทบจากอาชญากรรมคอมพิวเตอร์: ศึกษาเฉพาะกรณีการพนันทายผลฟุตบอลออนไลน์

Abstract

การวิจัยเรื่องผลกระทบจากอาชญากรรมคอมพิวเตอร์ ศึกษาเฉพาะกรณีของการพนันทายผล ฟุตบอลออนไลน์ มีวัตถุประสงค์เพื่อ (1) ศึกษาถึงปัจจัยต่างๆที่มีผลกระทบจากอาชญากรรมคอมพิวเตอร์ ในกรณีการพนันทายผลฟุตบอลออนไลน์ (2) ศึกษาผลกระทบที่เกิดขึ้นจากอาชญากรรมคอมพิวเตอร์ ในกรณีการพนันทายผลฟุตบอลออนไลน์ และ (3) ศึกษาหาแนวทางในการป้องกันและปราบปราม การพนันทายผลฟุตบอลออนไลน์ โดยใช้การวิจัยเชิงผสมผสาน (mixed methodology) คือ การวิจัยเอกสาร ที่เป็นการศึกษาวิเคราะห์รายละเอียดจากข้อมูลทุติยภูมิที่เกี่ยวข้อง ในส่วนของข้อมูลปฐมภูมินั้นจะได้จาก การใช้การวิจัยเชิงคุณภาพ (qualitative research) และ วิธีการเชิงปริมาณ (quantitative research) สำหรับ ประชากรและกลุ่มตัวอย่าง ประกอบด้วย เจ้าหน้าที่ระดับสูง (ตำแหน่งสูง) จากสำนักงานตำรวจ แห่งชาติ เจ้าหน้าที่ตำรวจผู้มีหน้าที่โดยตรง เช่น กองปราบปราม ตำรวจท้องที่ เจ้ามือโต๊ะบอล คนเดินโพย ผู้เล่นรายใหญ่ นักวิชาการด้านคอมพิวเตอร์ ผู้เชี่ยวชาญจากกระทรวง ICT รวมทั้ง ผู้ต้องหาในคดีที่เกี่ยวข้อง กับการพนันฟุตบอลออนไลน์ รวมทั้งผู้พิพากษาและอัยการ

ผลการวิจัย พบว่า ในการควบคุมการเล่นพนันฟุตบอลนั้น ประกอบไปด้วย (1) ด้านกฎหมายต้องมี ความเข้มงวดและจริงจังมากยิ่งขึ้นนั้น (2) การปราบปรามโดยเจ้าหน้าที่ตำรวจต้องมีมาตรการอย่างจริงจังมี การบังคับใช้กฎหมายอย่างเคร่งครัด เฉียบขาด (3) จัดให้มีกิจกรรมรณรงค์ให้ประชาชนเลิกเล่นพนันฟุตบอล ต่อต้านการเล่นการพนันฟุตบอล (4) มหาวิทยาลัยควรสอดส่องดูแลนักศึกษาในสังกัดว่ามีพฤติกรรมการเล่น พนันฟุตบอลหรือไม่ เพราะก่อให้เกิดปัญหาสังคมอย่างอื่นตามมาอีกหลายอย่าง ควรมีการรณรงค์การเลิกเล่น การพนันฟุตบอล เพื่อให้ใช้เวลาให้เป็นประโยชน์ และไม่หมกมุ่นกับการพนันฟุตบอลจนเกินไป (5) รัฐบาล ควรตั้งหน่วยงานขึ้นมารับผิดชอบโดยตรง ปรับปรุงแก้ไขกฎหมายให้สอดคล้องเหมาะสม มีบทลงโทษที่ชัดเจน และหนักมากขึ้น (6)ไม่ควรปล่อยให้มีการโฆษณาเกี่ยวกับการพนันฟุตบอลทางสื่อมวลชนทุกประเภท

โดยที่การปราบปรามการเล่นพนันฟุตบอลบอล ต้องการร่วมมือจากทุกฝ่าย ทั้งภาคเจ้าหน้าที่ของ รัฐจากคนในครอบครัว และจากสังคม ทุกฝ่ายต้องให้ความสำคัญที่ต้องร่วมมือกันเพื่อแก้ปัญหาไม่ใช่ปล่อย จนลุกลามไปทั่ว ด้านกฎหมาย ควรมีการปรับปรุงเพื่อให้เอื้ออำนวยต่อการปราบปรามและดำเนินคดีต่อ ผู้กระทำผิด รัฐบาลควรมีการออกกฎหมายเกี่ยวกับการพนันฟุตบอลให้ทันเหตุการณ์ มีการกระชับเจ้าหน้าที่ที่ เกี่ยวข้องปราบปรามและจับกุมการเล่นพนันฟุตบอลอย่างจริงจังและมีบทลงโทษสำหรับเจ้าหน้าที่ที่ประพฤติ ตัวไม่เหมาะสมมีความควรคุมสื่อมวลชนให้แนะนำแต่ข่าวสารที่สร้างสรรค์

THE IMPACT OF THE CYBER CRIME: A CASE STUDY OF ONLINE FOOTBALL BETTING

In this this research of The Impact of the Cyber Crime: A Case Study of Online Football Betting, aims to (1) study a variety of factors affected by computer crime in the case of online football prediction betting, (2) study impact from computer crime in the case of online football prediction betting, and (3) study the guidelines for suppression of computer crime in the case of online football prediction betting based upon the Mixed Methodology, namelym the documentary research from secondary information concerned. For primary information, it is based on the Qualitative Research and the Quantitative Research. The populations and sample groups comprised the top management of the Royal Thai Police the direct officers, such as Crime Suppression Division, local police officers, football betting hosts, football betting recipients, big betters, computer academics, experts from Ministry of ICT, and the alleged persons in relation to the online football prediction betting, inclusive of judges and public prosecutors.

According to the results of the Research, the control of football betting was composed of 5 aspects, namely, (1) on more strict and serious laws; (2) on suppression, the police officers had to have strict and serious measures to enforce the laws; (3) on campaign, people should be caused to cease football betting; (4) on universities, they ought to monitor their students to see whether they committed football betting or not because it would cause several resulting social problems, there should be campaigns to cease football betting to spend the students’ time to be useful, and should not to be too engrossed in football betting; and (5) the government should establish an agency to be directly responsible for football betting, should improve the laws in accordance with and as appropriate for the football betting, and have express and heavier penalties, and (6) on advertising, advertising on the football betting via every category of mass media should be permitted.

Whereas the football betting suppression shall be cooperated by every parties, both public officers and family members, and by societies. Every party would emphasize problem-solving, not let it be widely spread. On laws, they should amend to make the suppression and action entry against the offenders be easier. The government ought to issue and update laws on football betting, ought to seriously reiterate the relevant officers to suppress and arrest the football betting and ought to have penalties against the officers with inappropriate behaviors and ought to control the mass media to broadcast sole creative news.
