รายงานวิจัยเรื่องการสอนกฎหมาย: ศึกษาเปรียบเทียบวิธีการสอนแบบบรรยาย การสอนแบบถามตอบ และการสอนแบบทบทวนและถาม

Abstract

วิชากฎหมายเป็นศาสตร์ที่เกี่ยวกับความยุติธรรมและชีวิตของคน เพื่อให้ผู้ประกอบวิชาชีพทาง นิติศาสตร์มีความรู้ความสามรถ อาจารย์สอนกฎหมายจึงควรจัดการเรียนการสอนที่พัฒนานักศึกษากฎหมาย ให้เป็นนักกฎหมายที่ดี ผู้วิจัยจึงทำการวิจัยนี้ โดยทำการวิจัยเอกสาร ร่วมกับการวิจัยเชิงคุณภาพและ การวิจัยเชิงปริมาณ

ผลการวิจัยเอกสารพบว่า การสอนกฎหมายนั้น วิธีการสอนที่เหมาะสมได้แก่ การสอนแบบบรรยาย การสอนแบบถามตอบ และการสอนแบบทบทวนและถาม ดังนั้น ผู้วิจัยจึงทำการวิจัยเชิงทดลองด้วยการสอน และการวิจัยเชิงคุณภาพด้วยการสัมภาษณ์และการสังเกตในระหว่างสอน โดยทำวิจัยทั้งสิ้นเป็นเวลาสองปี การศึกษา

ผลการวิจัยพบว่า วิธีการถามตอบเป็นวิธีการสอนที่เหมาะสมกับนักศึกษากฎหมายไทยที่สุด เนื่องจาก การถามตอบเป็นการสอนที่กระตุ้นให้นักศึกษามีความตื่นตัว มีการคิดและอภิปรายตามเนื้อหาที่สอนบรรยาย และค้นพบข้อกฎหมายด้วยตนเอง ส่วนการการสอนแบบทบทวนและถามเป็นวิธีการสอนที่สามารถพัฒนา นักศึกษากฎหมายได้ดีที่สุด เนื่องจากทำให้นักศึกษาที่เก่งสามารถพัฒนาความรู้ได้มากขึ้น เพราะผู้สอน สามารถสอนเนื้อหาที่ลึกและยากได้ทันทีโดยไม่ต้องปูพื้นฐานความรู้ของนักศึกษาก่อน แต่เมื่อนักศึกษาไทยมัก ไม่ค่อยขยันทบทวนเนื้อหาก่อนการเรียน จึงทำให้การสอนแบบทบทวนและถามไม่ประสบความสำเร็จ

A Research on Teaching of Lows: A comparative Study of Lecturing method, Question-Answer Method and Reviewed and questioning method

Law is the science that deals with justice and people’s lives, to provide legal professionals with a deep knowledge and capacity. Professor of Law should be teaching law students to develop and become a good lawyer so the author studies on this with qualitative and quantitative research.

Research documents found the appropriate law teaching is Lecturing method, Question-Answer Method and Reviewed and questioning method. Therefore the author does the experimental research with teaching and qualitative research with interviews and observations during teaching for two years.

The results showed that Question-Answer Method is the most proper way to teach law students in Thailand. Since Question-Answer Method is a teaching that encourages students to be active, creative thinking and discuss on the content of teaching and lecturing then discover the legal point by themselves. The Reviewed and questioning method is the best solution to develop law students because it allows students to progress their knowledge further since the instructor can teach a profound and rigid ground without provide the basis of knowledge to students first. However, Thai students are not always diligent to review their lessons prior to the course content, as a result, the way of reviewed and questioning method become unsuccessful.
