บทคัดย่อ
ในปี พ.ศ. 2556 รัฐบาลพรรคเพื่อไทยซึ่งได้รับการสนับสนุนจากทักษิณ ชินวัตร ได้เสนอญัตติให้มีการแก้ไขรัฐธรรมนูญ พ.ศ. 2550 ในประเด็นที่มาของสมาชิกวุฒิสภา โดยให้สมาชิกวุฒิสภามาจากการเลือกตั้งทั้งหมด รัฐธรรมนูญ พ.ศ. 2550 ซึ่งยกร่างภายหลังรัฐประหารในปี พ.ศ. 2549 ได้กำหนดให้วุฒิสภามาจากการเลือกตั้งและสรรหาอย่างละครึ่ง ศาลรัฐธรรมนูญได้มีคำวินิจฉัยซึ่งเป็นที่วิพากษ์วิจารณ์กันในสังคมวงกว้าง โดยศาลรัฐธรรมนูญได้วินิจฉัยว่าการเสนอแก้ไขรัฐธรรมนูญในประเด็นที่มาของสมาชิกวุฒิสภาขัดต่อรัฐธรรมนูญ เป็นความพยายามล้มล้างการปกครองในระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุข บทความนี้ต้องการหาคำตอบว่าทำไมการแก้ไขรัฐธรรมนูญในครั้งนี้ถึงไม่ประสบความสำเร็จ บทความนี้เสนอข้อถกเถียงว่า การแก้ไขรัฐธรรมนูญครั้งนี้ควรที่จะทำความเข้าใจในฐานะการต่อสู้ทางการเมืองระหว่างฝ่ายชนชั้นนำใหม่ที่มาจากการเลือกตั้ง นำโดยทักษิณ ชินวัตรและพรรคการเมืองของเขา ซึ่งมีคะแนนเสียงส่วนใหญ่เป็นฐานของความชอบธรรม กับฝ่ายชนชั้นนำเก่า (กองทัพ และระบบราชการ) ซึ่งอ้างอิงความชอบธรรมจากสถาบันจารีตประเพณีและพยายามที่จะคงรักษาอำนาจและอิทธิพลผ่านสถาบันการเมืองที่ไม่ได้มาจากการเลือกตั้ง
