Legal Problems on Protection of Crime Victims’ Rights Caused by Non-prosecution Order of public Prosecutor

This dissertation is intended to study law enforcement problems concerning the protection of crime victim’s rights, including concepts and theories relating to the protection of crime victim’s rights, caused by non-prosecution order of public prosecutor issued in accordance with the Criminal Procedure Code, the Act on the Compensation for Injured Persons and Expenses of and Compensation for the Accused in Criminal Cases B.E.2544 (2001), the Act on Protection of Witnesses in Criminal Cases B.E.2546 (2003), the Official Information Act B.E.2540 (1997), and the Justice Fund Act B.E.2558 (2015) as well as some foreign concepts and theories which is aiming at proposing the guidelines for drafting the law on the protection victim’s rights which would be suitable to Thailand.
This research reveals that it is essential to adapt the international standards on the protection of crime victim’s rights to be implemented in Thailand so that the aforementioned problems can be solved properly. The main recommendation is to consolidate legal issues concerned, and gather them to be a new draft law entitled “the Act on Protection of Crime Victims’ Rights Caused by Non-prosecution Order of Public Prosecutor B.E. ….”. This new draft law is expected to efficiently enhance Thailand’s legal system on the protection of crime victim’s right caused by non-prosecution order of public prosecutor.
