ปัญหาทางกฎหมายเกี่ยวกับการชำระหนี้อย่างอื่นแทนหนี้เงิน: ศึกษาเฉพาะกรณีการชำระหนี้ด้วยกระทำการหรืองดเว้นกระทำการ

Abstract
The objectives of this article are to (1) study the conceptual framework, the theories, the principles and the history of the performance of obligation which is not only the delivery of money and (2) to analyze the root cause and the solution of the debt payment with execution or non-execution.
The use of documentary research methodology has been applied to this article. The resources are consist of legislation, document, articles, the final judgement from the supreme, the meeting minutes, the printing medias and the related online contents from the local and global governments.
The research result shows no legislation is available to handle the performance in lieu on monetary obligation by performance or forbearance. Therefore, the creditor could take advantage of a gap in the law. According to the class inequality, the debtor may have no choice to negotiate with the creditor. Section 321 and 322 could be resolved the remission when the debt has been finished the execution or non-execution. It could not be resolved when the litigant has just done the agreement to deliver the debt payment with any others instead of money.
Due to the fact that the creditors always have the bargaining power than the debtor. The debtor is afraid of against their creditor. Section 14 of the Labour Protect Act and the Unfair Contract Term Act should be adaptable in this case and in fairness be considered by the judge.
