LEGAL PROBLEM ABOUT PREVENTIVE MEASURES OF RECIDIVISMIN SEXUAL OR VIOLENT OFFENSES ACT B.E. 2565 (2022): SPECIFIC STUDY ON SEXUAL OFFENSE

Abstract
The main objective of this research is to analyze and to find out guidelines for solving legal problems about the Preventive Measures of Recidivism in Sexual or Violent Offenses Act, B.E. 2565 (2022), in the case of sexual offense only. It is qualitative research by conducting documentary research.
According to the research outcome, the Preventive Measures of Recidivism in Sexual or Violent Offenses Act, B.E. 2565 (2022), in the case of sexual offense, still has the problem about the count of sexual offense, i.e. there is enforcement with a few counts of sexual offense. As regards the problem about surveillance measures, there are 13 measures as imposed; however, there is no particular measure of sexual offense. And there is another problem, i.e. there is an unclear provision concerning medical measures against sexual offense.
This research has a suggestion that Section 3 and Section 22 of the Preventive Measures of Recidivism in Sexual or Violent Offenses Act, B.E. 2565 (2022) should be amended. And the ministerial regulation should be issued in order to support a measure for injecting a drug to reduce sex hormones.
