บทคัดย่อ
งานวิจัยนี้มีวัตถุประสงค์หลักเพื่อวิเคราะห์หาแนวทางแก้ไขปัญหากฎหมายเกี่ยวกับพระราชบัญญัติมาตรการป้องกันการกระทำความผิดซ้ำในคดีความผิดเกี่ยวกับเพศหรือที่ใช้ความรุนแรง พ.ศ. 2565 เฉพาะกรณีความผิดเกี่ยวกับเพศ โดยใช้การวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสาร
ผลการวิจัยพบว่าพระราชบัญญัติมาตรการป้องกันการกระทำความผิดซ้ำในคดีความผิดเกี่ยวกับเพศหรือที่ใช้ความรุนแรง พ.ศ. 2565 เฉพาะกรณีความผิดเกี่ยวกับเพศ ยังมีปัญหาเกี่ยวกับฐานความผิดในคดีความผิดเกี่ยวกับเพศที่มีการบังคับใช้กับคดีความผิดเกี่ยวกับเพศเพียงไม่กี่ฐานความผิด ปัญหาเกี่ยวกับมาตรการเฝ้าระวังในคดีความผิดเกี่ยวกับเพศที่มีการกำหนดไว้เพียง 13 มาตรการ ซึ่งไม่มีมาตรการเฉพาะความผิดเกี่ยวกับเพศ และปัญหาเกี่ยวกับมาตรการทางการแพทย์ในคดีความผิดเกี่ยวกับเพศที่ยังบัญญัติไว้ไม่ชัดเจน
งานวิจัยนี้มีข้อเสนอแนะให้แก้ไขมาตรา 3 และมาตรา 22 แห่งพระราชบัญญัติมาตรการป้องกันการกระทำความผิดซ้ำในคดีความผิดเกี่ยวกับเพศหรือที่ใช้ความรุนแรง พ.ศ. 2565 และตรากฎกระทรวงเพื่อรองรับมาตรการฉีดยาลดฮอร์โมนเพศ
