บทคัดย่อ
งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาการคุมขังในสถานที่อื่นที่ไม่ใช่เรือนจำ ศึกษาเฉพาะกรณีระเบียบกรมราชทัณฑ์ ว่าด้วยการดำเนินการสำหรับการคุมขังในสถานที่คุมขัง พ.ศ. 2566 โดยใช้ระเบียบวิธีวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสาร ศึกษากฎหมายไทยเปรียบเทียบกับรัฐนิวยอร์ก สหรัฐอเมริกา และราชอาณาจักรนิวซีแลนด์
ผลการวิจัยพบว่าการให้ผู้ต้องขังมาจำคุกในสถานที่อื่นที่ไม่ใช่เรือนจำ เป็นการบำบัดฟื้นฟูแก้ไขผู้ต้องขังให้กลับคืนสู่สังคมได้เร็วมากขึ้น และลดปัญหาความแออัดในเรือนจำ ซึ่งอยู่ในอำนาจของกรมราชทัณฑ์ กรมราชทัณฑ์จึงมีอำนาจตราระเบียบกรมราชทัณฑ์ ว่าด้วยการดำเนินการสำหรับการคุมขังในสถานที่คุมขัง พ.ศ. 2566 แต่ควรหนดคณะทำงานและคุณสมบัติของผู้ต้องขังที่สามารถจำคุกในสถานที่อื่นที่ไม่ใช่เรือนจำให้มีความเหมาะสม เพิ่มคณะทำงานให้มีหน่วยงานอื่นทั้งภาครัฐและภาคเอกชนเข้ามาเป็นคณะทำงาน และกำหนดให้ผู้ต้องขังต้องรับโทษในเรือนจำก่อนที่จะสามารถมาคุมขังในสถานที่อื่นที่ไม่ใช่เรือนจำได้
งานวิจัยนี้มีข้อเสนอแนะให้แก้ไขระเบียบกรมราชทัณฑ์ ว่าด้วยการดำเนินการสำหรับการคุมขังในสถานที่คุมขัง พ.ศ.2566 ข้อ 4 และประกาศกรมราชทัณฑ์ เรื่อง กำหนดคุณสมบัติเฉพาะ ลักษณะต้องห้าม และวิธีการคุมขังผู้ต้องขังในสถานที่คุมขัง ตามระเบียบกรมราชทัณฑ์ ว่าด้วยการดำเนินการสำหรับการคุมขังในสถานที่คุมขัง พ.ศ. 2566 พ.ศ. 2568 ข้อ 3
