Abstract

Financial Operations and Guides 2006, 2008 have been enforced since 2008 and                      the 2nd amendment, 2016. In enforcing the said Act, there is a problem about camouflage agents in requesting to conduct a tour business. There is a problem that foreigners are tour operators, using Thai people as shareholders instead of not holding real shares. And in addition, there is no penalty for camouflage agents that do not actually engage in business.

The research found that: Business of foreigners in Thailand For tourism businesses The proportion of foreign shareholders in some companies is almost 100%. And relying on the legal gap for Thai people who agree to be hired as representatives to hold shares on behalf of foreigners. Causing problems in revenue collection in the country. And when there are problems with tourists, foreign business operators are not in the process to solve the problem. Because being in a foreign country. And there is no penalty for foreign entrepreneurs hiring Thai people as agents. Therefore not afraid of the law. All of the above problems are legal problems that must be resolved. To make the tourism industry in Thailand more stable in all aspects and to enforce the law actually according to the spirit of the law
