Abstract
This Independent study on Protection of landowners' rights from deferring the right to build this high-voltage transmission tower. Its objectives are to study concepts, theories and laws related to compensation payments, deferrals and deferral periods. Formulate suggestions and changes to the law and procedures for the payment of compensation for deferral of rights and the period of deferral. By studying the sources of information, public documents, factual evidence and rulings of various courts regarding the payment of compensation and the deferral period.
Research substantiated hypothesis by evidence that found Electricity Generating Authority of Thailand has never been fair to the landowners in the following matters. First, there is no reform of remedy for landowners. EGAT still uses the same practice that has been around for decades. It can be seen from the land owners who are dissatisfied with the payment of compensation have brought the matter to the administrative court.
This research suggests EGAT: should updated rules to help people and affected landowners; should amend rules to help people and landowners to receive fair compensation and speedy process. Therefore, it is suggested that EGAT should revise or review its practices and criteria for compensation, deferrals, and deferral periods.
