Independence Security and Performance Security of the Office of the Attorney General

Abstract

This research paper aims to study (1) the of independence and the performance security of the of the Office of the Attorney General (2) the condition of the security of independence and the performance of the Office of the Attorney General and (3) to seek appropriate solutions to the problems of security of independence and the performance of the Office of the Attorney General. The researchers used the qualitative research methodology by using 3 methods of data collection, namely document research, in-depth interviews of 20 people and focus group discussion of 10 people, and analyzed the data by using content analysis techniques.


The research results found that the Constitution of the Kingdom of Thailand B.E. 2560 Section 248, the Public Prosecutors Act B.E. 2553 and the prosecution of the Office of the Attorney General are not in accordance with the security of independence and the performance of duties of the Office of the Attorney General. Therefore, it must be rectified for the Office of the Attorney General to have an agency responsible for the administrative work with autonomy in administration. The Committee of Administrative Officers shall have powers and duties in relation to the personnel administration of administrative officials. And the Legal Operation shall be separated from the administrative administration to be Legal Work department in each Case Office.
