Legal Problems Regarding the Operations of Cremation Welfare Associations

Abstract
This research article aims to study (1) concepts and theories related to the operations of cremation welfare funds; (2) cremation welfare laws in the jurisdiction of the Kingdom of Thailand and selected foreign jurisdictions; (3) analyze problems concerning the operations of the Cremation Welfare Associations of Thailand in comparison with apposite foreign laws; and (4) propose for amendment the Cremation Welfare Act B.E. 2545 and related Ministerial Announcements for the end greater efficiency. The researchers used the qualitative research methodology by using 3 methods of data collection, namely document research, in-depth interviews of 15 people, questionnaire for the percentage of 60 people, and focus group discussion of 7 people, and analyzed the data by using content analysis techniques and comparison.
The research results found that (1) concepts and theories related to cremation welfare, such as the concept of cremation and community welfare theory, etc. (2) the foreign cremation pattern is different from that of Thailand which is made in the form of a limited company and directors must hold a license and (3) the Cremation Welfare Act B.E. 2545 still poses legal problems that require amendment in respect of the issues of persuading others persons who have no interest to become members of the Cremation Welfare Associations and who dubiously identify themselves as having qualifications for receiving welfare monies; qualification of members and of the committee members concerning the actual legal domicile; overlapping powers between parties acting as registrars and the committee members of Cremation Welfare Associations.
