ปัญหากฎหมายเกี่ยวกับการดำเนินกิจการของสมาคมฌาปนกิจสงเคราะห์

บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดและทฤษฎีที่เกี่ยวข้องกับการฌาปนกิจสงเคราะห์ (2) ศึกษากฎหมายฌาปนกิจศพของประเทศไทยและต่างประเทศ (3) ศึกษาและวิเคราะห์ปัญหาเกี่ยวกับการดำเนินกิจการของสมาคมฌาปนกิจสงเคราะห์ของไทยเปรียบเทียบกับต่างประเทศ (4) เสนอแนะแนวทางในการปรับปรุงพระราชบัญญัติการฌาปนกิจสงเคราะห์ พ.ศ. 2545 และประกาศกระทรวงที่เกี่ยวข้องให้มีประสิทธิภาพในการควบคุมการดำเนินกิจการของสมาคมฯ ผู้วิจัยใช้รูปแบบการวิจัยเชิงคุณภาพ โดยใช้เครื่องมือในการเก็บรวบรวมข้อมูล ได้แก่ การวิจัยเอกสาร การสัมภาษณ์เจาะลึก จำนวน 15 คน การตอบแบบสอบถาม เพื่อหาค่าร้อยละ จำนวน 60 คน และการสนทนากลุ่ม จำนวน 7 คน และวิเคราะห์ข้อมูลโดยใช้เทคนิคการวิเคราะห์เนื้อหาและเปรียบเทียบ
ผลการวิจัย พบว่า (1) แนวคิดและทฤษฎีที่เกี่ยวข้องกับการฌาปนกิจสงเคราะห์ ได้แก่ แนวคิดการฌาปนกิจสงเคราะห์และทฤษฎีสวัสดิการชุมชน ฯลฯ (2) รูปแบบการฌาปนกิจของต่างประเทศจะต่างจากของไทยที่ทำในรูปแบบของบริษัท จำกัด และกรรมการจะต้องมีใบอนุญาต และ (3) พระราชบัญญัติการฌาปนกิจสงเคราะห์ พ.ศ. 2545 ยังคงมีปัญหาข้อกฎหมายที่ต้องแก้ไขในประเด็นเรื่องการนำบุคคลอื่นที่ตนไม่มีส่วนได้เสียสมัครเป็นสมาชิกสมาคมฌาปนกิจสงเคราะห์และระบุให้ตนเองเป็นผู้รับเงินสงเคราะห์ คุณสมบัติของสมาชิกและคุณสมบัติของกรรมการที่เกี่ยวกับภูมิลำเนาความทับซ้อนระหว่างผู้ทำหน้าที่นายทะเบียนกับผู้ที่เป็นกรรมการสมาคมฌาปนกิจสงเคราะห์
