Main Article Content
Abstract
This academic article aims to analyze the problems of legal measures to protect users of security guard companies. by applying the principles of consumer protection, the Constitution of the Kingdom of Thailand B.E. 2560, the Business Security Act B.E. 2558 and the Consumer Protection Act B.E. 2522. The United Kingdom’s and Federal Republic of Germany’s security user protection laws were used as a framework for analysis.
The results of the analysis revealed that the Security Business Act B.E. 2558 has a problem with the protection of security rights. The law requires the company to provide security guard personnel. But some security guards are not properly trained. This put consumers in disadvantageous situation and receiving improper care. For the issue of protection of rights related to contracts between the company and the consumer, the law specifies the details of the employment contract, but there is no immediate remedial process if a damage occurs. Therefore, it is necessary to amend the said law to better protect the rights of users of security companies.
