Law for the Protection of Franchise Business

Abstract

In this research, the researchers examines (1) franchise law in foreign jurisdictions; (2) the conditions of problems concerning the conduct of the franchise business in Thailand; and to provide (3) guidelines for drafting franchise law for Thailand. The researcher used the qualitative research methodology by using 3 methods of data collection, namely document research, in-depth interviews of 23 people and focus group discussion of 9 people. The data analysis was conducted by using content analysis techniques and comparison.

Findings are follows: The laws for the franchise business at present have some limitations and are widely variegated. This may confuse operators (franchisees) who do not understand laws as to which law would apply to themselves. Franchise operators (franchisees) are also faced with the problems of being taken advantage of by others (especially by franchisors) in the cases of contracts, disclosure of relevant information or facts, and methods of dispute settlement. Other findings are follows: (1) The form of franchise contracts (2) The form of the disclosure of information and detail (3) The dispute settlement procedures.
