Public Participation in Criminal Trials in Thai Courts of Justice: A Case Study of Jurors, Judges Pro Tempore, and Associate Judges

Abstract
The research article aim to (1) to study the theoretical concept of public participation in criminal proceedings, (2) to study the situation of criminal proceedings in the Thai courts of justice, and (3) to compare the Thai court’s criminal proceedings with abroad and (4) to develop and improve the criminal justice system of the Thai Court of Justice. The researchers used the qualitative research methodology by using 2 methods of data collection, namely documentary research and in-depth interviews. And analyzed the data by using content analysis techniques and comparison interpretation.
The results of the research revealed that the most common form of promoting public participation in criminal proceedings is the jury system, considering the qualifications, the number of people who can take part and the means by which the public will be primarily involved in the trial. As a result of research finding, the Jury Act B.E. ... was drafted, which has an accompanying legal structure, consisting of 9 Chapters, 31 Sections and Transitory Provisions with synopsis of the provisions. The essence of the provisions includes: qualifications, the jury acquisition of a jury in a criminal case, the body and the resolution of the jury jurors jurisdiction, jury leave rights, appeal and petition to the Supreme Court, remuneration and wages on leave and penalties. According to the results of this study, Thailand has developed and improved the criminal system of the Thai Court of Justice by adopting the jury system. The suggestion which should be applied in the future is that Thailand should develop and improve the criminal system of the Thai Courts of Justice by adopting the jury system. The Court of Justice should encourage the Jury Act B.E.... to come into effect.
