Problems in the Decisions of Election Cases of Organizations Performing Duties in the Decisions of Election Cases in Thailand

Abstract
This research article aims to study (1) the concepts and theories related to elections; investigates (2) the problems or obstacles concerning the adjudication of election cases and the organizations having the authority for the adjudication of election cases in the elections of members of the House of Representatives, members of the Senate, members of the local councils and local administrators in Thailand; compares (3) the organizations making adjudication of election cases in Thailand and abroad; and uses (4) the findings to draft an Act on the Establishment of Election Courts and Election Court Procedure in Thailand. The researcher used qualitative research methods and collected data through document research and in-depth interviews. Data were analyzed using content analysis techniques and comparative interpretation techniques.
Findings are as follows: Thailand needs to establish election courts to render decisions for offences related to elections for members of the House of Representatives, members of the Senate, members of the local councils, and local administrators. The authority of the Election Commission should be abolished in the orders for a new election or the orders to suspend the right to run for the election temporarily to the candidates for the election of members of the House of Representatives, members of the Senate, members of the local councils, and local administrators. The authority to consider the decisions of all types of election cases should be designated only to election courts whether the offences are civil, criminal, or administrative liabilities. The Election Commission should have only the authority in the administration of the election and the monitoring of the election to be honest and fair.
