มาตรการทางกฎหมายในการควบคุมการดื่มแอลกอฮอล์ในพื้นที่สาธารณะ

บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อประเมินศักยภาพมาตรการควบคุมการดื่มแอลกอฮอล์ในพื้นที่สาธารณะของไทยในปัจจุบัน สร้างกลไกความร่วมมือของผู้มีส่วนได้ส่วนเสีย และศึกษา วิเคราะห์นโยบาย กฎหมาย และปัญหาในการบังคับใช้กฎหมายในเรื่องการควบคุมการดื่มแอลกอฮอล์ในพื้นที่สาธารณะของไทยและต่างประเทศ ผู้วิจัยใช้วิธีการเก็บรวบรวมข้อมูลด้วยการวิจัยเอกสาร การตอบแบบสอบถามประชาชนในพื้นที่จังหวัดสงขลา จำนวน 500 คน และการสนทนากลุ่มผู้ให้ข้อมูลสำคัญ จำนวน 10 คน สถิติที่ใช้ ได้แก่ ร้อยละ ค่าเฉลี่ย ค่าเบี่ยงเบนมาตรฐาน t-test และ F-test และวิเคราะห์ข้อมูลโดยใช้เทคนิคการวิเคราะห์เนื้อหาและเปรียบเทียบ
ผลการวิจัย พบว่า ปัจจุบันพื้นที่สาธารณะซึ่งอยู่ภายใต้กฎหมายควบคุมเครื่องดื่มแอลกอฮอล์ยังมีไม่เพียงพอเพื่อคุ้มครองความปลอดภัยสาธารณะดังกล่าว ดังนั้น การควบคุมการดื่มเครื่องดื่มแอลกอฮอล์ในพื้นที่สาธารณะในประเทศไทยจำเป็นต้องอาศัยกลไกความร่วมมือระหว่างผู้บังคับใช้กฎหมาย ผู้ประกอบการร้านค้า และผู้บริโภค โดยเฉพาะพื้นที่ชุมชนและพื้นที่คาบเกี่ยวกับพื้นที่ของเอกชน อีกทั้งจำเป็นต้องขยายความหมายพื้นที่สาธารณะให้กว้างขึ้น ให้เหมือนกับมาตรการควบคุมการดื่มแอลกอฮอล์ในพื้นที่สาธารณะของสหรัฐอเมริกา ออสเตรเลีย ฝรั่งเศส และสิงคโปร์ ที่มีการกำหนดพื้นที่สาธารณะให้มีความหมายอย่างกว้าง ไม่ได้กำหนดเป็นพื้นที่อย่างใดอย่างหนึ่งเช่นเดียวกับประเทศไทย ทำให้การบังคับใช้กฎหมายสามารถบังคับใช้ได้อย่างมีประสิทธิภาพ
