บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาปัญหากฎหมายเกี่ยวกับการควบคุมผู้ประกอบธุรกิจสารเคมีกำจัดศัตรูพืชของไทย แนวคิดทฤษฎีเกี่ยวกับการควบคุมวัตถุอันตราย เปรียบเทียบกฎหมายที่เกี่ยวข้องกับการควบคุมผู้ประกอบธุรกิจสารเคมีกำจัดศัตรูพืชของไทยและต่างประเทศ วิเคราะห์สภาพปัญหาเกี่ยวกับการควบคุมผู้ประกอบธุรกิจสารเคมีกำจัดศัตรูพืชของไทย และแนวทางแก้ไขและพัฒนากฎหมายเกี่ยวกับการควบคุมผู้ประกอบธุรกิจสารเคมีกำจัดศัตรูพืชของไทย ผู้วิจัยใช้วิธีการวิจัยเชิงคุณภาพ โดยเก็บรวบรวมข้อมูลด้วยการวิจัยเอกสาร การสัมภาษณ์เชิงลึก และการอภิปรายกลุ่มสนทนาแบบเจาะจง และวิเคราะห์ข้อมูลโดยใช้เทคนิคการวิเคราะห์เนื้อหาและการวิเคราะห์เปรียบเทียบ
ผลการวิจัย พบว่า พระราชบัญญัติวัตถุอันตราย พ.ศ. 2535 ที่มีลักษณะเป็นกฎหมายกลางที่ใช้ควบคุมวัตถุอันตรายทุกชนิด ส่งผลให้มีปัญหาโครงสร้างและสภาพบังคับของพระราชบัญญัติวัตถุอันตราย พ.ศ. 2535 ปัญหาการขอต่ออายุใบอนุญาต ปัญหาวัตถุอันตรายทางการเกษตรปลอม ผิดมาตรฐาน และเสื่อมคุณภาพ และปัญหาการโฆษณาและฉลากสารเคมีกำจัดศัตรูพืช ดังนั้น ควรออกกฎหมายสารเคมีกำจัดศัตรูพืชที่มีโครงสร้างขอบเขตการบังคับใช้มุ่งเน้นวัตถุอันตรายทางการเกษตรโดยตรงแยกออกจากพระราชบัญญัติวัตถุอันตราย พ.ศ. 2535 กำหนดให้ผู้มีความประสงค์จะขอต่ออายุใบอนุญาตมีหน้าที่ต้องแจ้งจำนวนวัตถุอันตรายที่ครอบครอง กำหนดให้วัตถุอันตรายที่แสดงกำหนดเวลาที่วัตถุอันตรายหมดอายุใช้เกินความเป็นจริงให้ถือว่าเป็นวัตถุอันตรายปลอม และกำหนดให้มีกฎหมายและหน่วยงานหลักที่รับผิดชอบดูแลโฆษณาและฉลากเกี่ยวกับสารเคมีทางเกษตรโดยเฉพาะ รวมทั้งควรมีร่างพระราชบัญญัติสารเคมีกำจัดศัตรูพืช พ.ศ....
