บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาความหมาย วิวัฒนาการและประวัติความเป็นมา แนวคิดทฤษฎี กฎหมายที่เกี่ยวข้องกับการคุ้มครองทางสังคมของผู้สูงอายุ ปัญหาทางสังคมของผู้สูงอายุและปัญหาการบังคับใช้กฎหมายในการคุ้มครองทางสังคมของผู้สูงอายุตามพระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 วิเคราะห์และเปรียบเทียบมาตรการที่เกี่ยวกับการคุ้มครองทางสังคมของผู้สูงอายุตามพระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 ในประเทศไทยและต่างประเทศ และเสนอแนะให้หน่วยงานที่เกี่ยวข้องกับผู้สูงอายุนำไปแก้ไขให้ผู้สูงอายุได้รับการคุ้มครองทางสังคมตามนโยบายที่รัฐกำหนดไว้ ผู้วิจัยใช้วิธีการวิจัยเชิงคุณภาพ โดยเก็บรวบรวมข้อมูลด้วยการวิจัยเอกสาร การสัมภาษณ์เชิงลึก และการอภิปรายกลุ่มสนทนาแบบเจาะจง และวิเคราะห์ข้อมูลโดยใช้เทคนิคการวิเคราะห์เนื้อหา
ผลการวิจัย พบว่า ปัญหาทางสังคมของผู้สูงอายุและปัญหาการบังคับใช้กฎหมายในการคุ้มครองทางสังคมของผู้สูงอายุ ตามพระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 ประกอบด้วยปัญหาการเกิดอุบัติเหตุและปัญหาทางด้านสุขภาพ ปัญหาทางเศรษฐกิจ ปัญหาการถูกทอดทิ้ง ปัญหาการล่วงละเมิดต่อผู้สูงอายุ ปัญหาที่อยู่อาศัย ปัญหาการไม่ทราบสิทธิอันพึงมีของผู้สูงอายุ ปัญหาเกี่ยวสิทธิของผู้สูงอายุที่เกี่ยวข้องทางคดี ปัญหาในด้านการช่วยเหลือ จัดการทรัพย์สินผู้สูงอายุ พระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 ไม่ครอบคลุมและไม่ชัดเจนหน่วยงานที่มีหน้าที่รับผิดชอบผู้สูงอายุ การขาดการมีส่วนร่วมของภาคเอกชนและชุมชน ดังนั้น มาตรการทางกฎหมายที่เหมาะสมในการคุ้มครองทางสังคมของผู้สูงอายุ คือ การแก้ไขกฎหมายให้ครอบคลุมและชัดเจน การปรับปรุงการบริหารจัดการหน่วยงานที่มีหน้าที่รับผิดชอบผู้สูงอายุ การพัฒนาที่อยู่อาศัยสำหรับผู้สูงอายุ และการพัฒนาและส่งเสริมการมีส่วนร่วมของชุมชนและสังคม
