Criminal Prosecution with Good Faith

Abstract

Although the Constitution of the Kingdom of Thailand B.E. 2560 will protect persons who are defendants in criminal cases by assuming that the defendants are presumed innocent until the final judgment of guilty, before those persons will prove themselves to the end of the judicial process as the innocent persons, in reality, they are already affected on whether psychological, reputation, property, or even freedom.  As for the State itself which has the duty to protect the rights of criminal defendants, it has to allocate budgets for legal assistance to the criminal defendants.  The lawsuit should therefore be conducted in good faith according to the legal proverb - ‘He who comes to the Court must come with clean hands’ in order to prevent the use of criminal charges in order to just bully others.
