ประสิทธิผลของการบังคับใช้กฎหมายความรับผิดในผลิตภัณฑ์เพื่อการคุ้มครองผู้บริโภค

บทคัดย่อ
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษา ปัจจัยของการบังคับใช้กฎหมายความรับผิดในผลิตภัณฑ์ เพื่อการคุ้มครองผู้บริโภค และประสิทธิผลของการบังคับใช้กฎหมายของความรับผิดในผลิตภัณฑ์ เพื่อการคุ้มครองผู้บริโภค วิธีการศึกษาใช้การวิจัยเชิงปริมาณโดยทำแบบสอบถามทนายความในกรุงเทพและปริมณฑล ใช้โปรแกรม LISREL วิเคราะห์ข้อมูล หาปัจจัยของการบังคับใช้กฎหมายความรับผิดในผลิตภัณฑ์ และการใช้วิธีการศึกษาวิจัยเชิงคุณภาพ โดยการวิจัยเอกสาร และสัมภาษณ์เจาะลึกผู้เชี่ยวชาญ ที่เป็นผู้ให้ข้อมูลหลัก ผลการศึกษาพบว่า (1) การที่ผู้บริโภคได้รับความเป็นธรรม ขึ้นอยู่กับ การที่ผู้บริโภคได้รับการเยียวยาความเสียหาย การที่ผู้ผลิตตระหนักรู้ต่อความรับผิดในผลิตภัณฑ์ และการที่ผู้บริโภคฟ้องคดีได้โดยตรง (2) การทำให้ผู้ผลิตตระหนักรู้ต่อความรับผิดในผลิตภัณฑ์ ขึ้นอยู่กับ การที่ผู้บริโภคได้รับการเยียวยาค่าเสียหาย และการที่ผู้บริโภคฟ้องคดีได้โดยตรง (3) การที่ผู้บริโภคได้รับการเยียวยาความเสียหาย ขึ้นอยู่กับ การที่ผู้บริโภคฟ้องคดีได้โดยตรง ในส่วนของประสิทธิผลของการบังคับใช้กฎหมายความรับผิดในผลิตภัณฑ์ ที่ทำให้เกิดความเป็นธรรมมากที่สุดคือ การที่ผู้ผลิตตระหนักรู้ต่อความรับผิดในผลิตภัณฑ์ ซึ่งเป็นการค้นพบที่เป็นองค์ความรู้ใหม่ ของทฤษฎีธรรมาภิบาลและบรรษัทภิบาล ที่ให้น้ำหนักของประสิทธิผลของการบังคับใช้กฎหมายอยู่ภายใต้ความรับผิดชอบต่อสังคมขององค์กรธุรกิจ ทั้งนี้ข้อเสนอหลักของการวิจัยนี้ได้ชี้ให้เห็นความสำคัญของการกำหนดนโยบายที่เน้นต้นทางการผลิต ถ้าต้นทางดี ประชาชนผุ้บริโภคปลายทางก็ได้รับหลักประกันที่ดี การบังคับใช้กฎหมายก็จะสามารถบรรลุประสิทธิผล
