สิทธิมนุษยชน : ปัญหาในมโนทัศน์ และการนำเข้ามาในประเทศไทย

มโนทัศน์เรื่องสิทธิมนุษยชนสามารถถอยหลังกลับไปได้ถึงความคิดเรื่องธรรมชาติของมนุษย์ทั้งในแนวคิด ในศาสนาคริสต์และในสกุลความคิดแบบพันธสัญญา ตัวมโนทัศน์ได้ทวีความสำคัญเมื่อนำมาใช้ในทางการ เมือง ทั้งในคำประกาศอิสรภาพของสหรัฐอเมริกา รัฐบัญญัติสิทธิในรัฐธรรมนูญสหรัฐฯ หรือในปฏิญญาสิทธิ มนุษยชนของสหประชาชาติ เมื่อความคิดดังกล่าวถูกนำเข้ามาในประเทศไทย สิทธิมนุษยชนตกอยู่ในกลุ่ม เดียวกับความคิดทางการเมืองอื่น ๆ ที่ถูกนำเข้าคือ ถูกบิดยืดให้เข้ากับบริบทของไทย การพัฒนาการของมโนทัศน์ และการบิดยืดได้ก่อปัญหาให้กับตัวมโนทัศน์เองและการนำเข้ามโนทัศน์มาใช้ในไทย ทั้งการสูญเสียการอ้าง ธรรมชาติของมนุษย์ การเพิ่มขึ้นของจำนวนสิทธิที่ปราศจากขอบเขต ปัญหาเหล่านี้ส่งผลให้มโนทัศน์เรื่องสิทธิ มนุษยชนมีความสำคัญทางการเมือง แต่ปราศจากพลังที่จะพัฒนาหรือเปลี่ยนแปลงความสัมพันธ์ระหว่างรัฐ กับพลเมือง หรือระหว่างพลเมืองกับพลเมืองตามมโนทัศน์เรื่องสิทธิมนุษยชนนั้น
